Terms of Service

1. Acceptance of Terms

By accessing or using any Pingverse product or service ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services. The Services are operated by Pingverse ( "we," "us," or "our").

2. Eligibility

You must be at least 13 years old to use our Services. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account Registration

To use certain Services, you must create an account. You agree to provide accurate, current, and complete information, and to update it as necessary. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

4. Permitted Use

You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable law or regulation
  • Infringe on the rights of others
  • Transmit harmful, offensive, or illegal content
  • Attempt to gain unauthorized access to any part of our Services
  • Interfere with or disrupt the operation of our Services
  • Use our Services for commercial spam or unsolicited communications

5. Communications & Anti-Spam

You agree not to use Pingverse to send unsolicited messages, spam, or bulk communications. Automated messaging is prohibited without prior authorization. Violations may result in immediate account termination.

Pingverse sends transactional SMS messages only, including verification codes and security alerts. We do not send promotional or marketing SMS. You may opt out of SMS messages at any time by replying STOP.

6. Carrier Limitations

SMS delivery is subject to carrier network availability and filtering. We cannot guarantee delivery to all phone numbers or carriers. International SMS availability varies by country. PSTN voice calling quality and availability depend on carrier infrastructure and may vary by region.

7. Products and Services

Pingverse currently offers Pingverse Connect — a communications platform for messaging, voice and video calls, meetings, international calling, and travel eSIM data plans. Additional products may be introduced in the future, each with its own terms specific to its functionality. By using a specific product, you agree to any applicable product-specific terms.

8. Payments, Subscriptions & Refunds

8.1 Payments

Certain Services require payment. Web and Android payments are processed by our secure payment provider; iOS in-app purchases are processed by Apple. By making a purchase you agree to the applicable processor's terms of service. We do not store full payment card information.

8.2 Subscriptions

Subscription Plans (Plus, Pro, Business) auto-renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You may cancel at any time:

  • iOS: Settings → [Your Name] → Subscriptions, or apps.apple.com/account/subscriptions
  • Android: Google Play → Profile → Payments & Subscriptions → Subscriptions
  • Web: Pingverse Connect → Billing → Manage Subscription

Pingverse does not directly issue prorated refunds for partial billing periods. Apple and Google may grant subscription refunds at their sole discretion through their respective platforms.

8.3 Calling Credit Top-ups

Calling credit purchased through Pingverse is non-refundable once used. Unused credit may be refunded within 30 days of purchase by contacting support@pingverse.com. "Unused" means the portion of credit not yet captured against a call or other paid action. Refunds under USD 5.00 may not be processed because payment-processor fees would exceed the refund amount.

8.4 Gift Credits

Gift credits remain refundable to the original purchaser (the gifter) within 30 days of purchase, provided the recipient has not consumed them. Once consumed, gift credits are non-refundable.

8.5 Promotional Credits

Credits issued by Pingverse for promotions, beta testing, support resolution, or marketing campaigns have no cash value and may be granted, modified, or revoked at our discretion. Promotional credits cannot be refunded for cash.

8.6 eSIM Data Plans

eSIM data plans are non-refundable once activated by your device or used on a network. Unactivated eSIM plans may be refunded within 30 days of purchase. Activation failure due to a device or carrier issue is reviewed on request; in confirmed activation-failure cases we issue a full refund or a replacement plan, at the user's preference.

8.7 App Store and Google Play Purchases

Purchases made through Apple App Store or Google Play (including subscriptions and consumable in-app purchases) are governed by their respective refund policies. Pingverse cannot directly refund these charges. To request a refund, contact Apple via reportaproblem.apple.com or Google through your Google Play order history. At your request we will provide reasonable supporting information to those processes.

8.8 EU and UK Customers — 14-Day Withdrawal Waiver

If you are located in the European Union or United Kingdom, the Consumer Rights Directive normally grants a 14-day right of withdrawal for digital services. By purchasing calling credit or activating an eSIM plan you expressly consent to immediate digital performance and acknowledge that, as a result, your 14-day withdrawal right ceases on first use of the credit or activation of the eSIM. Where no consumption or activation has occurred, the 14-day withdrawal right remains available.

8.9 How to Request a Refund

Send a refund request to support@pingverse.com with your account email, the approximate date of purchase, and the amount in question. Approved refunds are returned to the original payment method when possible; where the original method is unavailable (closed card, expired wallet, etc.) refunds are issued as Pingverse account credit. Refund decisions are typically returned within five business days.

8.10 Chargebacks and Disputes

If you believe a charge is unauthorized or incorrect, contact us at support@pingverse.com within 30 days so we can investigate. Filing a chargeback with your bank without first contacting us removes our ability to resolve the issue directly and, where we determine the dispute was filed in bad faith, may result in account suspension and forfeiture of any remaining wallet balance. Where a chargeback is upheld in your favor in good faith, no fee is assessed.

9. Intellectual Property

All content, features, and functionality of our Services are owned by Pingverse and are protected by intellectual property laws. "Pingverse" and the Pingverse logo are trademarks of Pingverse.

You retain ownership of content you create or upload through our Services. By using our Services, you grant us a limited license to process, store, and transmit your content as necessary to operate the Services.

10. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our Services will be uninterrupted, secure, or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, Pingverse shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services.

12. Termination

We may suspend or terminate your access to our Services at any time for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by contacting us.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through our Services or by email. Continued use of our Services after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by the laws of the State of New York, without regard to its conflict of law provisions.
